This privacy policy (the "Privacy Policy") applies to your use of the website and our Services (as defined under the jhana "Terms & Conditions") offered through the web application at www.jhana.ai (“jhana platform”) owned by Jhana, Inc., a Delaware, United States based entity hosted at www.jhana.ai. This Privacy Policy forms part and parcel of the Terms & Conditions for the Site. The terms "we", "our" and "us", both in uppercase and lowercase refer to Jhana Labs Private Limited an Indian private limited company with its registered office at 7, Vinnagar Apts, 10/12, Sterling Road, 1st Cross Street, Nungambakkam, Chennai, TN 600034, India and its corporate office at No.103, 1st Floor, Jeevanbheema Nagar, HAL II Stage, 14th Main, Indiranagar, Bengluru, KA 560038, India (the “Company”, “We” “us”) which acts as a sales agent for the business operations within India for Jhana Inc., a Delaware, United States, based entity having its registered office at New Burton Road, Suite 201, in the City of Dover, County of Kent, Delaware 19904 ("Jhana Inc."). The terms "you", "your" and "user", both in uppercase and lowercase refer to you, as a user of jhana platform. The term "Personal Information" means information that you provide to us which personally identifies you to be contacted or identified, such as your name, phone number, email address, and any other data that is tied to such information. Our practices and procedures in relation to the collection and use of Personal Information have been set-out below in order to ensure safe usage of the Website for You. Our site may contain links to other sites not owned or controlled by Us and We are not responsible for the privacy practices of those sites. We encourage You to be aware when You leave Our sites or applications and to read the privacy policies of other sites that may collect Your Personal Information.

Collection of Personal Information

"Personal Information" is defined as any information that relates to an identifiable individual. It includes any data that can be used, either alone or in combination with other information, to identify or distinguish an individual, for example the individual’s name, postal address, email address, and mobile number indicating to that particular person or is identifiable. When anonymous information is directly or indirectly associated with Personal Information, the resulting information can also be treated as Personal Information. We may ask for the following personal information about you when you visit our website, sign up or try our services, and collect or store your responses:

We collect information about You and Your use of Our Service, Your interactions with Us and Our Services, as well as information regarding Your computer or other devices used to access Our Services (such as Our Web Application and other viewing devices). This information may include, but is not limited to:
  •         a. Activities on the jhana platform such as type of pages viewed, time spent on pages, frequency of usage, etc.
  •         b. Information collected via the use of cookies and other technologies.

"User Data" is any information related to an identified or identifiable individual that is provided to or collected by us. This encompasses a wide range of data types, including but not limited to:

  • i. Provided Information: data that is actively provided through various means such as filling out details on our website, communicating with us via email or other channels, or engaging with our Services. This includes personal details like name, address, employer information, and geographical location.
  • ii. Collected Information: data that is automatically collected when You interact with our Services. This includes technical details like IP address, time logs, and interaction logs, as well as user-generated content which may include inputs and outputs during the use of our Services, and files uploaded to the jhana platform.

Definitions
"Artificial Intelligence", "AI", "Models", "Language Model", "LLM"

Any sequence, architecture, or algorithm for artificial intelligence that is developed or served by Us. Such Models might be owned, operated, and controlled by Us, or by Third Parties who have been engaged by Us. Based on context, the term "Models" might also refer to the trained Weights of such models as stored in our systems.

"Weights" (of a Model)

The weights and biases of a Model are its learned parameters that are physically stored in Our or a Third Party's systems and activated to make generations for the Model.

"Training", "Train", "Finetuning" (a Model)

The process of refining and teaching a Model to perceive, interpret, and learn by observing a specific set of data, known as a “Training Dataset,” is known as "training" the Model. If Training begins from scratch, it is referred to as "pre-training". If training resumes from the weights of a previously trained Model and incrementally refines said Model, it is referred to as "finetuning."

"Third Party"

An entity other than Us or Our Affiliates, typically referring to companies and organizations that are partners, vendors, service providers, or otherwise engaged by Us to provide Services to You.

"Profile Information"

Any information or data that You may voluntarily supply or upload to Your account, for example, Your profile picture, address, firm name, and other details relating to Your profession, career, practice, domain area of expertise, work experience, and profession or business.

"Services"

The Services offered by the jhana platform include Paralegal Chat Service, Search Service, Doc Intelligence Service, and other functionalities as described in Our Terms & Conditions document. These Services are provided on an "as-is" and "as available" basis for information purposes only.

"Core Services"

Core Services reference the subset of Services that are provided by Us and are integral to the unique features and functionalities of the jhana platform. This includes our AI assistants such as those in Our Paralegal and Doc Intelligence Services and tools like our case law and statutes databases. Core Services exclude basic atomic units of modern websites providing functions such as authentication, email, network management, or streaming, and also exclude services that are not integral to the experience of using the jhana platform such as those for analytics or marketing.

"the jhana(.ai) Platform"

The web application accessible at www.jhana.ai, through which the Services are provided, as defined in Our Terms & Conditions document.

"Payment Gateway Service Provider(s)"

A Third Party that provides payment gateway, payment processing, or other digital financial services for the jhana platform, including but not limited to PhonePe Private Limited and ICICI Bank Limited and their corresponding services.

We use only essential cookies and similar technologies that are necessary for the core functionalities of our website, such as, those for security, network management, and accessibility. We do not use cookies for marketing, advertising, or analytics purposes. Essential cookies are vital for the proper functioning of our website. They enable basic features such as page navigation, secure login, and access to certain areas of the site. These cookies are necessary for the legitimate purpose of providing a service you have explicitly requested, and without them, the website cannot function properly. By using our website, you agree to the use of essential cookies as described in our Cookie Policy. How we do use Your data
Purpose of collection, storage, processing and sharing of Your data

We use Personal Information to provide, analyse, administer, enhance and personalise Our Service and marketing efforts, to process Your registration, and to communicate with You related to the cases mentioned below. For example, We use Personal Information to:

We may process Your personal data for certain other legitimate uses, if required in compliance with the Digital Personal Data Protection Act, 2023, Information Technology Act, 2000 and in compliance with any other laws and their requirements. In order to provide you the best experience and to meet our various business needs, We may disclose the Personal Information to various entities who may also come under the definition of data processors as per The Digital Personal Data Protection Act, 2023, including but not limited to, hosting service providers, cloud computing entities, IT service firms, marketing and advertising agencies, web analytics companies. These entities may access, process and store Personal Information as per the agreement entered with them. We will make efforts to disclose an updated list of key entities who are data processors and are engaged by Us. We use Third Parties for smooth functioning of the business including the Services provided at jhana platform. We will share the User Data with such Third Parties who may process the User Data as and when required for the purpose of providing the requested services. We use Third Party cloud providers to serve and store the data relevant to jhana platform. Our current primary cloud provider is Amazon Web Services (AWS), where We rent a cluster of computers, storage space, and security or networking services to serve the jhana platform. User data is stored in an encrypted form and hosted with up-to-date security and privacy practices. All such data is collected from Indian servers on Amazon Web Services and stored in databases and storage services from AWS within India. Access to jhana platform's servers are restricted to the webmaster, to whom as well User data is obscured, and otherwise, access is restricted by state-of-the-art encryption, identification, and authentication practices. Most Core Services on the jhana Platform are operated by proprietary implementations, and typically owned and managed by Us. Selectively, We do work with a few Third Party partners and vendors to provide parts of some core services. The following is a list of up-to-date providers whose services We use and whom might store, serve, analyse, or otherwise be exposed to material Personal Information and/or User Data:

In case of services requiring payment, We request credit card or other payment account information, which will be used solely for processing payments. Your financial information will not be stored by Us except for the name and address of the card holder, last four digits of card details, card issuer, and purchase details. Subject to Your prior consent and where necessary for processing future payments, Your financial information will be stored in encrypted form on secure servers of Our reputed Payment Gateway Service Providers who are beholden to treating Your Personal Information in accordance with this Privacy Policy Statement. We also may be required to share Your Personal Information when it is requested or required by law or by any court, tribunal or governmental agency. We may share Personal Information with employees, affiliates and third-party service providers for the purpose of processing Personal Information on Our behalf. We will take appropriate assurance from such parties to comply with this Privacy Policy and follow appropriate confidentiality and security measures. We may present Personal Information, usually in the form of aggregate statistics when We place advertisements with third-party advertisers, when We seek investment for the company, in a merger, acquisition, etc.

How we do NOT use Your data

We do not sell, rent, or lease Your Personal Information or User Data to any Third Party. We do not aggregate, distribute, or otherwise commercially exploit Your Personal Information or User Data. We do not Train any AI or Models with Your Personal Information or User Data. None of our AI systems or algorithms learn from or improve based on Your Personal Information or User Data, including your queries, messages, files, and profile information. When You use Our Services, your User Data such as queries, messages, files, and profile information is only ephemerally made available to the memory and context of Our AI systems. Our AI systems do not store, retain, or use Your User Data for any purpose other than to generate responses to Your queries. Our AI systems are run primarily on Models that are owned, hosted, and served by Us: none of the Models we deploy and serve "locally" within our own cloud infrastructure retain or train on Your Personal Information or User Data. Similarly, an up-to-date list of Model and API Third Party providers that we utilize is provided in this Privacy Policy. We only work with Third Parties who maintain equivalent privacy guarantees to Ours and that do not train on any user data collected via their APIs.

Choice to control Your information use
a. Managing Your Information

When You use the Services from www.jhana.ai (jhana platform or any of its sub sites), We make all reasonable efforts to provide You, as and when requested by You, with access to Your Personal Information and shall further ensure that any Personal Information or other information found to be inaccurate or deficient shall be corrected or amended as feasible, subject to any requirement for such Personal Information or other information to be retained by law or for legitimate business purposes. We ask individual Users to identify themselves and the Personal Information requested to be accessed, corrected or removed before processing such requests, and We may decline to process requests that would be extremely impractical, or for which access is not otherwise required. In any case, where We provide Personal Information access and correction, We perform this Service free of charge, except if doing so would require a disproportionate effort. Because of the way We maintain certain Services, after You delete Your Personal Information, residual copies may take a period of time before they are deleted from Our active servers and may remain in Our backup systems. Kindly ensure You use appropriate language in the subject line (e.g. Data Access Request, Data Portability Request, Data Deletion Request) while raising all such requests, to help Us process Your requests faster and more efficiently.

b. Rectification of Inaccurate or Incomplete Information

You can ask Us to correct inaccurate or incomplete Personal Information concerning You by sending Us an e-mail at team@jhana.ai. You can access and update some of Your Personal Information through Your account settings. You are responsible for keeping Your Personal Information up-to-date.

c. Data Retention and Erasure

We retain Your personal Personal Information as long as necessary for the legitimate interests specified in this policy and for Us to comply with Our legal obligations. If You no longer want Us to use Your Personal Information, You can request that We erase Your Personal Information and close Your account by sending Us an e-mail at team@jhana.ai. Please note that if You request the erasure of Your Personal Information;

  • • We may retain some of Your Personal Information as necessary for Our legitimate business interests, such as fraud detection and prevention and enhancing safety.
  • • We may retain and use Your Personal Information to the extent necessary to comply with Our legal obligations and reasons of public interests. For example, We may keep some of Your information for tax, legal reporting and auditing obligations.
  • • Because We maintain copies of Personal Information to protect from accidental or malicious loss and destruction, residual copies of Your Personal Information may not be removed from Our backup systems for a limited period of time.

For withdrawing Your consent at any time during the tenure of Your subscription with Us, You may choose to do so by sending Us an e-mail at team@jhana.ai. We shall review Your request and may ask You to verify Your identity. After verification We will withdraw the consent for which request was made by You and stop any further processing of Your Personal Information. This may also lead to cancellation of Your subscription.

e. Objection to Processing

We may use Your Personal Information for marketing purposes. You may, at any time, ask Us to cease processing Your data for these marketing purposes by sending an email to Us. Please be aware that if You do not allow Us to collect Personal Information from You, We may not be able to deliver certain experiences, products, and Services to You, and some of Our Services may not be able to take account of Your interests and preferences. Children's Privacy

The jhana platform is not intentionally designed for or directed at persons Younger than 18 years of age. We consider it the responsibility of parents to monitor their children's use of Our Services. Nevertheless, it is Our policy not to collect and process any Personal Information from children below 18 years of age or offer to send any promotional materials to persons in that category. We do not seek or intend to seek or receive any Personal Information from children. Should a parent or guardian have reasons to believe that a minor has provided Us with Personal Information without their prior consent, please write to Us at team@jhana.ai to ensure that the Personal Information is removed from the jhana platform.

What do we do to keep Your data safe?

We take appropriate security measures to protect against any unauthorized access, alteration, modification, disclosure or destruction of data. These include internal reviews of Our data collection, storage and processing practices and security measures, including appropriate encryption to guard against unauthorized access to systems where We store personal data. We have implemented appropriate electronic, and managerial procedures to safeguard and help prevent unauthorized access to Your Personal Information and to maintain data security. These safeguards take into account the sensitivity of the information that We collect, process and store and the current state of technology. We follow generally accepted industry standards to protect the Personal Information submitted to Us, both during transmission and once We receive it. For Enterprises

We offer a customizable and broad range of services to Enterprises. Please contact us for more details. The Privacy Policy for enterprise customers is based on the Service Level Agreement executed as part of the engagement. Typically, when we integrate with Document Mangement Systems and cloud ecosystems at interfaces, we house these in a siloed and private version of the jhana platform. This private version exclusively provides Core Services to the Enterprise. We offer Training and Finetuning on Models as services to enterprises, where the AI learns from Your styles, templates, and legal histories in order to tailor its responses to Your specific use cases and needs. In such cases, You own the rights in perpetuity to the Models and Weights trained on Your enterprise data.
